    Consumer Protection Act

The Consumer Protection Act, 2019 is a landmark legislation enacted to safeguard the rights of consumers and promote transparency, accountability, and fairness in the marketplace. It replaces the earlier Act of 1986 and strengthens the mechanism for consumer dispute redressal in India. The law ensures that consumers are not exploited or misled by manufacturers, traders, or service providers and are empowered to claim compensation for any unfair or deficient service.

The Act defines a consumer as any person who buys goods or avails services for consideration, and it protects them against unfair trade practices, defective goods, deficient services, false advertising, overcharging, and negligence by service providers. It also covers online transactions and e-commerce platforms, recognizing the changing landscape of digital trade and virtual marketplaces.

A significant feature of this Act is the establishment of the Central Consumer Protection Authority (CCPA), which has the power to regulate matters relating to consumer rights, prevent unfair trade practices, and order the recall of unsafe goods or discontinuation of misleading advertisements.

The Act provides a three-tier redressal mechanism for resolving consumer disputes — through District, State, and National Consumer Disputes Redressal Commissions (DCDRC, SCDRC, NCDRC) — depending on the claim amount. It also introduces mediation cells within these forums to encourage faster and amicable settlements without lengthy litigation.
